The Lookout Towers VIP Reservation Program

These Terms and Conditions (“Terms”) govern participation in the VIP Reservation Program (“Program”) offered by The Lookout Towers LLC, a North Carolina limited liability company (“Company,” “we,” “us,” or “our”), to any individual or entity purchasing a VIP Reservation (“Client” or “you”). By purchasing or participating in this Program, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Program Overview

The VIP Reservation Program allows participants to secure early access to booking availability for The Lookout Towers properties prior to public release. Upon payment of a fifty-dollar (USD $50.00) refundable fee, Clients receive:

• Exclusive early access to book participating Lookout Towers accommodations on or after the official launch date.
  
  
• A one-time discount applicable toward a single future stay reservation.
  
  
• Priority communication regarding launch announcements, property details, and offers.
  
  

2. Payment and Refund Policy

All VIP Reservation payments are processed securely through Stripe under the legal entity The Lookout Towers LLC.

• The $50 VIP Reservation payment is fully refundable within the first three (3) months from the date of purchase.
  
  
• Refund requests must be submitted in writing to support@thelookouttowers.com and will be processed within thirty (30) days of approval.
  
  
• After three (3) months, the payment becomes non-refundable and remains valid as a credit toward a future reservation within the allowed time frame.
  
  
• The Company reserves the right to deny refund requests submitted after the three-month window, except as otherwise required by applicable law.
  
  

3. Credit Application and Validity

• The $50 payment shall be applied as a discount toward one future booking made through official Lookout Towers channels.
  
  
• The discount must be used within six (6) months of the launch date of the property associated with the VIP Program.
  
  
• Credits may not be divided across multiple stays or transferred between programs.
  
  
• Unused credits after six months will expire automatically with no cash value or further obligation from the Company.
  
  

4. Access and Booking Procedure

• Clients will receive a unique VIP access code via email on the official launch date.
  
  
• This code grants early booking access and the applicable discount.
  
  
• The discount and early access do not guarantee availability for specific dates, units, or tower locations. All reservations are subject to availability and standard booking policies.
  
  

5. Transfer and Gift Policy

VIP Reservations are personal and non-commercial, but may be gifted to another individual.
Reselling, auctioning, or otherwise commercially exploiting VIP access codes is strictly prohibited and will result in immediate cancellation without refund.

6. Cancellations, Delays, and Substitutions

In the event of project delays, rescheduling, or unforeseen circumstances preventing the intended launch:

• The Company reserves the right, at its sole discretion, to offer:
  (a) an alternative stay at another Lookout Towers property of similar value; or
  (b) a full refund of the $50 payment.
  
  
• The Client acknowledges that launch dates and property readiness are subject to construction schedules, regulatory approvals, and external factors beyond the Company’s control.
  
  
• The Company shall not be liable for incidental, indirect, or consequential damages arising from launch delays or cancellations.
  
  

7. Limitation of Liability

To the maximum extent permitted by law:

• The Company shall not be liable for any indirect, incidental, special, or consequential damages arising from participation in the Program or use of VIP benefits.
  
  
• The total aggregate liability of the Company, whether in contract, tort, or otherwise, shall not exceed the amount paid by the Client under this Program.
  
  
• The Client acknowledges and accepts that the Program provides early-access privileges and limited benefits, not a guaranteed reservation or lodging service.
  
  

8. Force Majeure

The Company shall not be held responsible for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, government restrictions, war, terrorism, labor disputes, epidemics, or technical failures.

9. Data Privacy and Communication

By purchasing the VIP Reservation, you consent to the collection and use of personal information (such as your name, email address, and payment data) for purposes of:

• Processing your reservation through Stripe;
  
  
• Sending communications related to launch announcements, booking instructions, and discount codes; and
  
  
• Customer service and verification purposes.
  
  

Your information will not be sold, leased, or shared with third parties except as required to fulfill these purposes or comply with applicable law. By enrolling in the Program, you also consent to receive limited promotional emails, which you may opt out of at any time.

10. Intellectual Property

All trademarks, service marks, logos, website content, and materials related to The Lookout Towers brand are the exclusive property of The Lookout Towers LLC. Participation in the Program does not grant any license or ownership rights to such intellectual property.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of “”, without regard to its conflict of law principles.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in “”, United States.

12. Amendments and Termination
